Electronic Records, Health Data and Minors

Electronic signatures, sensitive safety records and guardian authority requirements.

Part A — Electronic records and signatures

1. Consent to electronic format

A person choosing electronic signing agrees to receive, review and sign the identified document electronically and to receive a downloadable copy. Electronic acceptance has the same intended effect as a handwritten signature to the extent permitted by applicable law. The person may request a paper process from the Operator before signing if available.

2. Requirements and withdrawal

The signer needs a current browser, internet access and the ability to save or print a PDF/HTML copy. Consent may be withdrawn before signing without charge, but the Operator may require completion through another lawful method before participation. Withdrawal after signing does not invalidate the completed record.

3. Evidence

The Platform records the exact immutable document version, rendered hash, signer identity/role, booking/customer/organization UUIDs, UTC timestamp, IP address, user agent and signature/acceptance method. Corrections require a new version or documented amendment; an accepted record is never silently overwritten.

4. Capacity and authority

Each adult signs their own waiver, medical declaration and consent. A representative may sign only with legal authority recorded in the document. A lead booker cannot accept another adult's health declaration or liability release merely because they paid for the booking.

Part B — Medical and special-category information

5. Purpose and minimisation

Medical information is collected only to assess operational eligibility, request physician clearance, respond to emergencies, meet safety/legal duties and manage related claims. It is not medical diagnosis and is not used for unrelated marketing or general profiling.

The form must ask only questions necessary for the relevant activity and template version. Free-text diagnosis fields should be avoided where a yes/no response or clearance status is sufficient.

6. Consent and other legal grounds

Where explicit consent is the applicable condition, the participant affirmatively consents to the named Operator and authorised safety staff processing the identified health information for the booked activity. The system records the version and time. Consent may be withdrawn for future optional processing, but withdrawal may make safe participation impossible and does not require deletion of records lawfully retained for safety, legal obligations or claims.

The Operator must identify any different local condition it relies upon, such as vital interests, healthcare/safety rules or legal claims. The Platform must not claim that a generic privacy-policy checkbox alone is explicit health-data consent.

7. Access and disclosure

Medical data is restricted to staff who need it for eligibility, safety, emergency response, compliance or claims. It may be disclosed to a physician, insurer, certification body, emergency responder or authority only where requested/authorised or legally necessary. Access and material changes should be auditable.

8. Medical decision

The Platform may show missing-document or answer-based workflow flags, but does not diagnose, give medical advice or make the final safety decision. The Operator and, where required, a qualified physician decide participation. Participants must disclose material changes before activity.

Part C — minors and guardians

9. Guardian authority

For a minor, the signer confirms they are the parent or legal guardian, have authority to approve participation and provide accurate information, and have reviewed the booking, safety and operator documents. The record must include guardian name, contact, relationship, signature, minor identity/date of birth, document version and booking reference.

10. Assent and supervision

Where appropriate for age and law, the minor should receive an understandable explanation and provide assent. Guardian consent does not replace Operator age limits, certification rules, supervision ratios or duty of care. The Operator may refuse participation where safety or authority cannot be verified.

11. Separate documents

Medical consent, guardian participation consent, photo/media consent and liability/assumption-of-risk terms must remain separately identifiable. Optional media consent may not be required as a condition of receiving the service. No waiver excludes rights or liability that cannot legally be excluded.

Part D — operator document requirements

Every operator document used in a booking must show: Operator legal identity; title/purpose; jurisdiction; participant and booking identity; material risks/obligations; non-waivable-rights savings clause; version/effective date; retention/privacy reference; signature roles; and a downloadable completed copy. A template must be reviewed for the Operator's service location and law before publication. Publishing a global template is not a substitute for local legal review.
